1. Introduction

  1. Welcome to positive-intentions , a secure and comprehensive web-based peer-to-peer (P2P) communication platform designed to facilitate easy and intuitive connections between users. Our app offers text messaging, multimedia sharing, and voice calling for both one-on-one and group conversations, all without requiring registration or storing user data on any centralized servers of any party. By using positive-intentions, you can communicate with your peers directly, with all data stored locally on your browser's storage.
  2. Please read and accept these terms and conditions ("Terms") carefully before using positive-intentions. By accessing and using our app, you agree to be bound by these Terms. If you do not agree with these Terms, you cannot use positive-intentions. These Terms govern your use of the app, and any updates, modifications, or enhancements made to the app in the future. We reserve the right to change or modify these Terms at any time, and your continued use of the app constitutes your acceptance of such changes or modifications.

2. User eligibility

  1. Age Restriction: Users of the positive-intentions app must be at least 13 years of age or older. By using the app, you represent and warrant that you are of the required age or older and have the legal capacity to understand and accept these Terms.
  2. Geographical Availability: The positive-intentions app is available for use in countries and regions where WebRTC technology is legally permitted. By using the app, you confirm that you are located in a jurisdiction where the use of such technology is allowed.
  3. Regulatory Compliance: Users are responsible for ensuring that their use of the positive-intentions app complies with all applicable laws and regulations in their respective jurisdictions, including but not limited to data protection and privacy laws, telecommunications regulations, and any specific rules governing P2P communication.
  4. Intended Use: The positive-intentions app is designed for personal, non-commercial use. We strive to create a safe and inclusive environment for all users of the positive-intentions app. Users are expected to treat each other with respect and not engage in any activities that may be harmful or offensive to others. This includes, but is not limited to, harassment, discrimination, racism, sexism, hate speech, threats, or any other behaviour that may infringe upon the rights or well-being of others. However, as a P2P chat app using PeerJS and presented as a web app, we are unable to remove content from users or ban users.
  5. Responsible Use: We strive to create a safe and inclusive environment for all users of the positive-intentions app. Users are expected to treat each other with respect and not engage in any activities that may be harmful or offensive to others. This includes, but is not limited to, harassment, discrimination, racism, sexism, hate speech, threats, or any other behavior that may infringe upon the rights or well-being of others. We encourage all users to report any inappropriate behavior or content to us. However, as a P2P chat app using PeerJS and presented as a web app, we are unable to remove content or ban users.

By using the positive-intentions app, you agree to comply with these eligibility requirements and to use the app in a responsible and respectful manner.

3. Account registration and security:

  1. Display Names: Upon using the positive-intentions, users get an auto-generated display name. Users can edit a display name, which will be visible to other users within the app. Display names should be tasteful and not offensive.
  2. Unique Identifiers: The app will generate two unique identifiers for each user: a connection ID and a device/browser ID. Users are responsible for securely managing their connection IDs and sharing them only with trusted individuals.
  3. Data Storage: All user data is stored locally on the user's browser's storage, which can be accessed via the browser's inspect tools. Users are responsible for the security of their devices, operating systems, and browsers, and for following security best practices to protect their stored data.
  4. App Stability and Data Backup: The positive-intentions is a work-in-progress, and users should not rely on its stability. Breaking changes may be implemented as we continue to develop and improve the app. Users are responsible for backing up their data and should not expect the app to maintain data integrity during updates or changes.
  5. Responsible Use: Users are encouraged to exercise caution when sharing sensitive or personal information through the app. Do not disclose personal data to unknown users, and be aware of the risks associated with sharing information with others. By using the positive-intentions, you agree to use the app in a responsible and respectful manner, adhering to the guidelines outlined in the "User Eligibility" section.

4. User conduct and content:

  1. User Conduct: Users of the app are expected to conduct themselves in a respectful and responsible manner. By using the app, you agree not to engage in any activities that may be harmful or offensive to others, violate the rights of others, or otherwise interfere with the normal functioning of the app. This includes, but is not limited to:
    • Harassment, bullying, or intimidation of other users.
    • Discrimination or hate speech based on race, ethnicity, religion, gender, sexual orientation, or any other protected characteristic.
    • Posting or sharing content that is obscene, pornographic, excessively violent, or otherwise inappropriate for a general audience.
    • Engaging in illegal activities or encouraging others to do so.
    • Spamming, phishing, or engaging in other disruptive or deceptive practices.
    • Distributing viruses, malware, or other harmful software.
    • Infringing on the intellectual property rights, privacy rights, or any other rights of others.
    • Using the app may not be against the penal code.
  2. Content: Users are solely responsible for any content they create, transmit, or share using the positive-intentions app. By using the app, you represent and warrant that you have the necessary rights and permissions to use and share any content you provide and that your content does not violate any applicable laws or regulations.
  3. We strive to create a safe and inclusive environment for all users of the positive-intentions app. However, as a P2P chat app using PeerJS and presented as a web app, we are unable to remove content or ban users.

By using the app, you acknowledge and agree to these user conduct and content guidelines.

5. Intellectual property:

  1. Ownership: The intellectual property rights related to the positive-intentions, including but not limited to the app's name, logo, design, source code, and other proprietary elements, are owned by the company responsible for the app's development. The app is currently a proof of concept and not associated with any company.
  2. Respecting Intellectual Property Rights: Users are expected to respect the intellectual property rights of others when using the app. This includes, but is not limited to, not sharing copyrighted material, trademarks, or other proprietary content without the express permission of the rights holder. Unauthorized use or distribution of protected content may potentially result in legal liability.
  3. User Content: Users retain ownership of the intellectual property rights in any content they create or share within the app. By using the app and sharing content with peers, users acknowledge that they may be granting other users a non-exclusive license to access, use, reproduce, or modify the shared content.
  4. Infringement Claims: Currently, there are no formal procedures in place for handling intellectual property infringement claims. However, users are encouraged to be mindful of intellectual property rights when sharing content and to report any suspected infringement to the app's developers for further investigation.
  5. Performance Monitoring: We reserve the right to introduce tools and technologies for monitoring the performance of the app and improving its functionality. By using the app, you acknowledge and agree to this potential monitoring.

By using the positive-intentions, you acknowledge and agree to these intellectual property guidelines. If you believe that any intellectual property rights have been violated within the app, please report the issue to the app's developers for further investigation.

6. Data privacy and security:

  1. Data Storage: The app saves user and app data locally on the storage provided by the user's browser. Users are responsible for ensuring the security of their devices and browsers, and for following security best practices to protect their stored data. The company does not collect user data, apart from what is needed for monitoring tools to ensure the app's stability and to make improvements.
  2. Third-Party Services: The app uses PeerJS for establishing peer connections and the official PeerJS server as the connection broker. We are not affiliated with PeerJS and are not responsible for the management of the PeerJS server. We may also use Sentry.io for error monitoring and NLevel Software for analytics. We retain the right to add analytics tools to help manage the stability of the app and make improvements.
  3. Data Access and User Rights: Users can access their data through the app's user interface or their browser's inspect tools. The app may provide functionality to export data for backup purposes. Users have the right to delete any or all data stored within the app, subject to the limitations of the app's design and the nature of peer-to-peer communication.
  4. Data Retention: User data is retained for as long as the user and browser allow. Users are responsible for backing up their data and managing the data stored within the app.
  5. Reporting and Investigations: The app may include functionality to report users, and we reserve the right for this functionality to send necessary details for any investigation.
  6. Compliance with Laws: Users of the positive-intentions are responsible for complying with the laws in their place of residence. Users should be aware of and adhere to any applicable privacy laws and regulations. It is the user's responsibility to understand and comply with any specific laws that apply to their use of the app.

7. Third-party services and links:

  1. Third-Party Services and Links: The positive-intentions may use third-party services, tools, and libraries, such as PeerJS and its connection broker, to provide and enhance its functionality. We are not affiliated with, nor do we endorse or assume responsibility for, any third-party services, tools, or libraries used within the app. Users acknowledge that these third parties may have their own terms of service, privacy policies, and data handling practices, and that the positive-intentions is not responsible for the content, privacy, or security of these third parties.   2. In addition, the app may include or provide links to external websites or resources that are not under our control. We do not endorse or assume responsibility for the content, privacy policies, or practices of these external websites or resources. Users access and use these external websites or resources at their own risk.
  3. We reserve the right to add or remove third-party services, tools, libraries, or links at our discretion. By using the app, users acknowledge and agree to the potential risks and limitations associated with third-party services, tools, libraries, and links.

8. Modification and termination:

  1. Modification: As a proof of concept (POC), the app is subject to updates and modifications as we deem necessary for improving the app's functionality and performance. Users acknowledge that changes may be made without prior notice and may impact their experience using the app. It is the user's responsibility to regularly review the terms and conditions for any updates or changes.
  2. Termination by User: Users retain the right to terminate their use of the app at any time. To remove their data, users can utilize the app's data removal functionality or their browser's inspect tools to delete stored data.
  3. Termination by Company: Due to the P2P nature of the app, we do not have the ability to remove or ban users. However, users acknowledge that the app is a POC in a volatile state and may become unavailable at any time at our discretion.
  4. Discontinuation: In the event that the app is discontinued, users are responsible for ensuring the removal of their data from their devices and browsers. We are not responsible for any loss of data or functionality resulting from the discontinuation of the app.

9. Warranty disclaimer and limitation of liability:

  1. Warranty Disclaimer: The app is provided "as is" and "with all faults", without any warranties or guarantees of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. Users acknowledge and agree that their use of the app is at their sole risk, and that they are responsible for any damages or losses resulting from such use.
  2. As a proof of concept (POC), the app may have unexpected issues, errors, interruptions, or defects. We do not warrant that the app will be error-free, uninterrupted, or that any defects will be corrected. We make no representations or warranties regarding the app's performance, reliability, accuracy, or suitability for any particular purpose.
  3. Limitation of Liability: To the fullest extent permitted by applicable law, we, our affiliates, and our respective officers, directors, employees, and agents, shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from the use of or inability to use the app, even if we have been advised of the possibility of such damages.

Users acknowledge and agree that they are solely responsible for their use of the app and that we disclaim all liability for any actions, omissions, or consequences arising from or related to their use of the app.

10. Indemnification:

  1. Indemnification: Users agree to indemnify, defend, and hold harmless the app owner, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to their use of the app, their violation of these terms and conditions, or their infringement of any intellectual property or other rights of any third party.

Users shall defend the app owner and its affiliates at their own expense, and the app owner reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by users. Users agree to cooperate with the app owner in the defense of any claim subject to indemnification.

11. Governing law and dispute resolution:

  1. Governing Law: These terms and conditions and any disputes arising out of or in connection with the app or your use thereof shall be governed by and construed in accordance with the users local laws, without regard to its conflict of law principles.

  2. Dispute Resolution: In the event of any dispute, controversy, or claim arising out of or relating to these terms and conditions or your use of the app, the parties shall first attempt to resolve the dispute through good faith negotiations. If the dispute cannot be resolved through negotiations within a reasonable time, either party may submit the dispute to the local judicial system of the user.

12. Changes to terms and conditions:

  1. Changes to Terms and Conditions: The app owner reserves the right, in its sole discretion, to modify or update these terms and conditions at any time without prior notice. As the app is currently a proof of concept and in active development, users may not be notified of changes to the terms and conditions. Users are advised to periodically review the terms and conditions for any updates or modifications.

    Upon any update to the terms and conditions, the app may be temporarily locked, and users will be required to agree to the updated terms and conditions before regaining access to the app. By continuing to use the app after any modifications to the terms and conditions, users indicate their acceptance of such changes.
